1. Scope and contracting party
These General Terms and Conditions apply to all orders placed through arsmenzi.store. The contracting party is Arsmenzi, owner Göktan Zafer Arslan, Nordbergstr. 21, 74076 Heilbronn, Germany.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. An entrepreneur is a natural or legal person, or a partnership with legal capacity, acting in the exercise of its trade, business or profession.
2. Contract language and storage
The contract languages are German and English. We store the contract information and send the order details and these Terms to you in text form. Order information can also be reviewed in your customer account where available.
3. Offer and conclusion of contract
Product displays are an invitation to place an order and not a binding offer. You can correct your entries before submitting the order. By clicking the final order button, you submit a binding offer to purchase the products in your cart.
Receipt of your order is confirmed automatically. This confirmation does not by itself constitute acceptance unless it expressly states that the order has been accepted. A contract is concluded when we expressly accept the order, confirm dispatch or collect the payment, whichever occurs first.
4. Prices and payment
All prices displayed to consumers are total prices including statutory VAT. Shipping costs and other additional costs are shown separately before the order is submitted. The available payment methods are displayed during checkout.
If a payment cannot be completed or is reversed, we may withhold delivery until the amount due has been paid. Statutory rights remain unaffected.
5. Product information and availability
We take reasonable care to present products accurately. Minor colour differences caused by screens or photography may occur. If a product becomes unavailable after an order has been placed, we will inform you without undue delay and refund any payment made for the unavailable item. Your statutory rights remain unaffected.
6. Delivery
We deliver to the destinations available during checkout. The applicable delivery time and shipping costs are shown on the product page or during checkout. Delivery times begin after conclusion of the contract and, where advance payment is agreed, after receipt of payment.
Partial deliveries are permitted where reasonable for you and do not result in additional shipping costs.
7. Transfer of risk
For consumers, the risk of accidental loss or deterioration passes only when the goods are delivered to the consumer or a recipient designated by the consumer. This does not apply where the consumer independently commissions a carrier not previously offered by us. For entrepreneurs, the statutory rules on shipment purchases apply.
8. Retention of title
The goods remain our property until full payment has been received. For entrepreneurs, we retain title until all claims arising from the ongoing business relationship have been settled.
9. Withdrawal and voluntary returns
Consumers have the statutory right of withdrawal described in our Withdrawal Policy. Any additional voluntary return option is governed exclusively by the conditions stated there and does not restrict statutory rights.
10. Statutory warranty rights
The statutory law on liability for defects applies. Any manufacturer's warranty is additional and does not limit statutory rights. Please notify us of transport damage as soon as possible; failure to do so does not affect a consumer's statutory claims.
11. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act, and to the extent a guarantee has been assumed.
For slight negligence, we are liable for breach of an essential contractual obligation whose fulfilment is necessary for proper performance and on whose fulfilment the customer may regularly rely. Liability is then limited to typical, foreseeable damage. Mandatory statutory liability remains unaffected.
12. Customer obligations
You must provide complete and accurate delivery and contact information and ensure that delivery can be made. Additional costs caused by an incorrect address or culpable failure to accept delivery may be charged only where legally permissible and actually incurred.
13. Governing law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice does not remove mandatory protections under the law of the country of habitual residence.
For merchants, legal entities under public law and special public funds, the courts at our registered place of business have jurisdiction where legally permissible. No exclusive place of jurisdiction is agreed for consumers.
14. Dispute resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
15. Changes
The version in force when the order is placed applies to that order. Later changes do not apply retroactively to completed orders.
